1. Scope and Legal Nature

1.1 These Terms and Conditions (“Terms”) govern the access to and use of the JetShared

online platform (the “Platform”), including its website, mobile applications, and any associated

services operated by Blessed Destiny, LDA (“JetShared”,“we”,“us”,“our”).

1.2 JetShared operates as a technology and marketing intermediary, facilitating connections

between certified air charter operators, brokers, and consumers who wish to share private jet

flights.

1.3 JetShared is not an air carrier. It does not own, lease, or operate aircraft, and does not

exercise operational control over any flight. All flights are operated by independent, licensed

air carriers or brokers duly certified under applicable civil aviation regulations (EASA, CAA, FAA, or equivalent).

2. Acceptance of Terms

2.1 By accessing, registering, or using the Platform, the User (“you”,“your”) acknowledges that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy.

2.2 If you do not agree to these Terms, you must not use the Platform.

3. Services and Role of JetShared

3.1 JetShared provides an online booking and matching platform enabling users to:

  • View and compare private jet routes and available flights;
  • Connect and share flights with other verified travelers;
  • Complete bookings and payments securely through the Platform.

3.2 JetShared’s role is limited to:

(a) providing the technical and booking infrastructure;

(b) processing payments on behalf of certified operators or brokers;

(c) facilitating communication between users and certified partners.

3.3 JetShared does not:

  • Operate aircraft or provide air transportation;
  • Assume responsibility for flight safety, airworthiness, or crew performance;
  • Control flight scheduling, dispatch, or operational decisions.

3.4 The contract of carriage is formed exclusively between the User and the certified operator or broker identified at the time of booking.

4. Applicable Aviation Regulations

4.1 Flights booked through JetShared are conducted under the following frameworks:

  • European Operations: Regulation (EU) No. 965/2012 (EASA Air Operations), national Civil Aviation Authority (CAA) oversight, and EU insurance requirements under Regulation (EC) No. 785/2004.
  • United Kingdom Operations: Civil Aviation Authority (CAA) rules, mirroring EASA Air Ops, and UK GDPR data standards.
  • United States Operations: Federal Aviation Administration (FAA) and U.S. Department of Transportation (DOT) regulations, including 14 CFR Parts 119, 135, 205, 295, and 380.

4.2 JetShared ensures that U.S. partners hold valid FAA Part 135 air carrier certificates or operate under DOT Part 380 Public Charter authority as applicable.

4.3 JetShared does not market or sell any flight that would constitute an illegal air charter under FAA or DOT rules.

4.4 All operators on the Platform must comply with applicable safety, maintenance, and licensing regulations under their national aviation authorities.

5. Registration and Account

5.1 To use booking services, Users must create an account and provide accurate, complete, and current information.

5.2 JetShared may verify the identity of Users and passengers to comply with aviation security, anti-money laundering (AML), and know-your-customer (KYC) obligations.

5.3 Users are responsible for maintaining the confidentiality of their login credentials and all

activity under their account.

5.4 JetShared reserves the right to suspend or terminate any account that violates these Terms or applicable law.

6. Booking and Payment Terms

6.1 A booking made through JetShared constitutes a contract of carriage between the User and the identified certified operator or broker, not JetShared.

6.2 JetShared acts as a limited payment collection agent, authorized to collect and remit funds to the relevant operator or broker.

6.3 All payments are processed securely under EU PSD2 standards and applicable AML/CFT regulations.

6.4 For U.S. flights marketed to the public under DOT Public Charter rules (14 CFR Part 380), all passenger funds are held in an escrow or depository account until completion or lawful cancellation of the flight.6.5 JetShared is not responsible for any currency conversion fees, bank charges, or delays caused by third-party payment providers.

7. Disclosures for U.S. Operations

(Applicable when JetShared partners with U.S. entities or markets flights in the United States.)

7.1 In compliance with DOT Air Charter Broker Rules (14 CFR Part 295), JetShared will:

  • Disclose the name and certificate number of the operating air carrier before booking;
  • Identify its role clearly as an intermediary, not an air carrier;
  • Disclose whether JetShared carries liability insurance and provide details upon request;
  • State whether it acts as an agent for the customer or the air carrier.

7.2 For flights conducted as DOT Part 380 Public Charters:

  • JetShared will comply with all DOT filing and escrow requirements;
  • All advertisements will include the disclosure:

“JetShared acts solely as an intermediary and does not operate aircraft. All U.S. flights are conducted by FAA-certified Part 135 carriers or DOT-authorized public charter operators.”

8. Operator and Flight Information

8.1 Each flight listing identifies the operating air carrier or broker responsible for the flight.

8.2 JetShared verifies, to a commercially reasonable extent, that operators maintain valid

certification and insurance; however, JetShared cannot guarantee ongoing compliance.

8.3 Operators remain solely responsible for:

  • Operational control and safety;
  • Crew licensing and conduct;
  • Maintenance and airworthiness of aircraft;
  • Regulatory compliance and insurance coverage.

9. User Obligations

9.1 Users agree to use the Platform lawfully and not to:

  • Misrepresent identity or payment information;
  • Engage in resale or unauthorized promotion of flights;
  • Violate aviation, consumer, or data protection laws.

9.2 Users must provide accurate passport or identity details for themselves and all passengers when required for customs or border control purposes.

9.3 JetShared reserves the right to cancel bookings or accounts associated with fraudulent, illegal, or non-compliant activities.

10. Cancellations and Refunds

10.1 Cancellation and refund terms are governed by the operator’s or broker’s policies.

10.2 JetShared facilitates refunds strictly in accordance with the relevant partner’s instructions and applicable consumer protection law.

10.3 Refund eligibility and timing may vary depending on the type of operation (EU charter, U.S. Part 135, or DOT Part 380).

11. Insurance and Liability

11.1 All operators and brokers must maintain mandatory liability insurance as required by:

  • EU Regulation (EC) No. 785/2004: Minimum 250,000 SDR per passenger;
  • U.S. 14 CFR Part 205: Minimum USD 300,000 per passenger for small aircraft.

11.2 JetShared maintains professional indemnity and general liability insurance limited to its intermediary activities.

11.3 JetShared is not liable for:

  • Flight delays, accidents, or cancellations;
  • Loss or damage to baggage, goods, or property;
  • Any indirect, consequential, or punitive damages.

11.4 JetShared’s total liability shall not exceed the total booking fee paid by the User for the relevant transaction.

12. Intellectual Property

12.1 All trademarks, designs, software, content, and materials on the Platform are the exclusive property of JetShared or its licensors.

12.2 Users receive a limited, non-exclusive, non-transferable license to access and use the Platform solely for lawful booking purposes.

13. Data Protection and Privacy

13.1 JetShared processes all personal data in accordance with its Privacy Policy, the EU General Data Protection Regulation (GDPR), UK GDPR, Portuguese Law No. 58/2019, and, where applicable, U.S. privacy laws (e.g., CCPA).

13.2 For flights involving U.S. passengers, JetShared may share necessary passenger data with the FAA, DOT, TSA, and U.S. customs authorities as required by law.

14. Indemnification

Users agree to indemnify and hold harmless JetShared, its directors, employees, and affiliates from any claims, damages, or expenses arising from their breach of these Terms or misuse of the Platform.

15. Governing Law and Jurisdiction

15.1 These Terms shall be governed by Portuguese law.

15.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, except where mandatory consumer protection law requires otherwise (e.g., U.S. residents under federal law).

15.3 For UK Users, references to “GDPR” shall include the UK GDPR and Data Protection Act 2018.

16. Modifications

JetShared may revise these Terms at any time. Updates will be posted on the Platform with the effective date. Continued use constitutes acceptance of the updated Terms.
